This Privacy Policy (together with our Terms of Use and any other documents referred to in it) sets out the basis on which any Personal Data we collect from you, or that you provide to us, will be used, shared, or processed by us, and the safeguards we have in place to protect Personal Data.

Personal Data Collection. “Personal Data" refers to information that is connected to you, and may include your name, addresses, telephone number, email addresses, user name, password, and other specific information such as your organization’s employees or contacts at your customers, partners, or suppliers.

      • Personal Data you give to us. You may give us Personal Data by filling in forms on our Site or by corresponding with us by telephone, e-mail, or otherwise.
      • Information we collect about you. With regard to each of your visits to our Site, we use the following technologies to automatically collect information about you:
    • Cookies: these are small bits of information that are placed on the hard drive of your device. Cookies remember information about your activities on the Site and your preferences in order to make your visits to our Site more enjoyable and valuable to you by providing a customized experience.     • Fulfilling your requests. If you request something from Ixia, for example, a product or service, a call back, or specific marketing materials, we will use the Personal Data you provide to fulfil your request. To help us do this, we may share Personal Data with others, for instance, Ixia's business partners, financial institutions, shipping companies, or customs authorities involved in fulfilling your request.
    • Website use. We may use Personal Data we collect about you to improve the content of our Site and provide you with a personalized experience on our Site, such as providing you with content in which you may be interested and making navigation on our sites easier. Ixia does not control these websites and thus may not be held responsible for their practices relating to the confidentiality and security of your Personal Data.     • Providing technical support. We may use your Personal Data to provide support for products or services you have obtained from us, such as notifying you of a product update or fix.
    • The Personal Data you provide to Ixia, as well as the Personal Data we have collected about you indirectly through third parties, may be used by Ixia for marketing purposes. If such information includes your email address, postal address or telephone number, you may receive periodic emails, postal mailings or telephone (if you have explicitly agreed thereto) contact from us with information on new Ixia products and services, Ixia upcoming events or other Ixia marketing information.     • Information of business partners. If you represent an Ixia business partner (including a customer, supplier, etc.), we may use Personal Data provided to Ixia to administer and develop our business relationship with you, the business partner you represent, and Ixia business partners generally. We may also contact you as part of customer satisfaction surveys or for market research purposes, as well as use the information in connection with entering into or performing transactions with you, unless you have told us not to.
    • Information we receive from other sources. We may combine Personal Data with information you give to us and information we collect about you. We may use this information and the combined information for the purposes set out above (depending on the types of information we receive).
  2. Disclosure of Personal Data. Ixia may share Personal Data with selected third parties including:
    • Within our company. We may share personal Data with any member within our group.
    • Service providers. From time to time, we retain the services of third party companies and individuals to perform functions on our behalf in connection with the successful operation and continuous improvement of this Site. We may share Personal Data with selected third parties including (but not limited to):
      • Financial institutions, shipping companies, customs authorities, joint marketing partners, social media platforms, business partners, suppliers and sub-contractors for the performance of any contract we enter into with them or you (e.g., in order to process your order including the authorisation and validation of credit or debit card transactions, the provision of delivery services, the analysis of data).     • To provide Personal Data and services to our customers. This includes reporting to customers that license Ixia products information about the individuals that they authorize to utilize their licenses, as well as those individuals' usage patterns and aggregate information.
  3. International Transfers of Personal Data. Ixia is a global company with business processes, management structures, and technical systems that cross borders. The Personal Data that we collect from you may be transferred to, and stored at, a destination outside of the country in which it was originally collected. This may include transfers outside of United States and into the European Economic Area ("EEA"). It may also be processed by staff working outside of the United States who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. By submitting your Personal Data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that Personal Data is treated securely and in accordance with this Privacy Policy and applicable law. If you are located in the EEA, you, as a data controller, may only transfer Personal Data to Ixia, as a data processor, by entering into the EU standard contractual clause.
  4. Personal Data Security. Ixia has established measures to help keep the confidentiality, safety and integrity of its systems containing your Personal Data. Ixia implements reasonable physical, administrative, and technical safeguards to help us protect your Personal Data from unauthorized access, use and disclosure. While Ixia attempts to protect the Personal Data in our possession, no security system is perfect, and Ixia cannot promise that information about you will remain secure in all circumstances.
  5. Retention of Personal Data. Ixia will keep Personal Data no longer than is necessary to achieve the purposes for which it was collected or no longer than is provide by law, or until you withdraw your consent.
  6. Right to object to marketing. You have the right to ask us not to process your Personal Data for marketing purposes. You can exercise your right to prevent such processing by contacting us at any time at the address listed below in the Section titled “Contact”. You can also at any time tell us not to send you marketing communications, even if you have previously consented to receiving them, (a) by mail by following the instructions that are included in a particular promotion; (b) by e-mail by clicking on the unsubscribe link within the marketing e-mails you receive from us; or (c) by SMS message by following the "STOP" instructions provided with the message.
  7. Accessing and modifying Personal Data. You have the right to access Personal Data held about you and can request access to your Personal Data. You also have the right to update and correct inaccuracies in your Personal Data, and have the information blocked or deleted, as appropriate. If you would like deletion or removal of your Personal Data, access to any Personal Data which you have provided to us in a machine-readable format, or if you would like your Personal Data to be transferred directly to another data controller, please submit your request to us at the address listed below in the Section titled “Contact”.
  9. Third party websites. Our Site may, from time to time, contain links to and from the websites of our subsidiaries, affiliates, partner networks, and advertisers.   10. Non-waiver. No failure to exercise and no delay on the part of Ixia in exercising any right, remedy, power or privilege of Ixia under this Privacy Policy and no course of dealing between us shall be construed or operate as a waiver, nor shall any single or partial exercise of any right, remedy, power or privilege preclude any other or further exercise thereof or the exercise of any other right, remedy, power or privilege on the part of Ixia.

Under California Civil Code sections 1798.83-1798.84, California residents who have an established business relationship with Ixia are entitled to ask us for a notice describing what categories of personal customer information we share with third parties for their direct marketing purposes. This notice will identify the categories of information shared with and will include a list of the third parties with which it is shared, along with their names and addresses.   14. Do Not Track (DNT). DNT is a concept that has been promoted by regulatory agencies such as the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing Internet users to control the tracking of their online activities across websites by using browser settings. The World Wide Web Consortium (W3C) has been working with industry groups, Internet browsers, technology companies, and regulators to develop a DNT technology standard. While some progress has been made, it has been slow. No standard has been adopted to date. As such, Ixia does not use "do not track" signals.
